1. Our commitment to copyright compliance
Apollo Group TV ("we", "our" or "us") is firmly committed to respecting and protecting intellectual property rights. We operate in full compliance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and other applicable copyright laws worldwide.
We do not host, store, upload or distribute any copyrighted audio, video or multimedia content on our servers. Our service operates solely as a technology intermediary platform allowing users to access content made available by third-party providers via publicly accessible streams.
2. Avis de protection (Safe Harbor) (17 U.S.C. § 512)
Apollo Group TV qualifies as a service provider under Section 512 of the DMCA. As such, we benefit from the DMCA's safe harbor provisions provided that we:
- Do not have actual knowledge that the content on our platform is infringing;
- Are not aware of facts or circumstances making the infringing activity apparent;
- Act expeditiously to remove or disable access to content once we become aware of or gain knowledge of infringement;
- Do not receive a financial benefit directly attributable to the infringing activity when we have the right and ability to control such activity;
- Have designated an agent to receive notifications of alleged infringement.

4. Filing a DMCA Takedown Notice
If you believe that your copyrighted work has been infringed through our service, you may submit a written notification to our DMCA agent. Your notification must include all of the following elements as required by 17 U.S.C. § 512(c)(3):
Required information for a valid DMCA notification
- Identification of the copyrighted work — A description of the copyrighted work you believe has been infringed. If multiple works are involved, a representative list of such works.
- Identification of infringing content — The specific URLs or sufficient details to allow us to locate the content you believe to be infringing.
- Your contact information — Your name, mailing address, phone number and email address.
- Good faith statement — A statement that you have a good faith belief that the use of the content in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy — A statement, made under penalty of perjury, that the information you have provided is accurate and that you are the copyright owner, or are authorized to act on behalf of the copyright owner.
- Physical or electronic signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Important: Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that content is infringing may be liable for damages, including costs and attorney's fees.
5. Our response to valid DMCA notifications
Upon receipt of a valid DMCA takedown notification, we will take the following actions:
- Expeditiously remove or disable access to the allegedly infringing content;
- Notify the content provider, member or user that we have removed or disabled access to the content;
- Terminate, in appropriate circumstances, the accounts of repeat infringers in accordance with our Terms of Service.
6. Counter-Notification (17 U.S.C. § 512(g))
If you believe that the removed or disabled content is not infringing, or that you have authorization from the copyright owner or the law to post and use the content, you may file a counter-notification with our DMCA agent containing the following:
- Your physical or electronic signature;
- Identification of the content that was removed or disabled and the location where it appeared before removal;
- A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled by mistake or misidentification;
- Your name, address, phone number and a statement that you consent to the jurisdiction of the federal district court in the district where your address is located (or the Central District of California if you are outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or their agent.
Upon receipt of a valid counter-notification, we may restore the removed content within 10 to 14 business days, unless the original complainant initiates legal action against the content provider.
7. Repeat infringer policy
In accordance with the DMCA, we maintain a policy to terminate, in appropriate circumstances, the accounts and access of users deemed to be repeat infringers. We may, at our sole discretion:
- Terminate the accounts of users who have received multiple valid DMCA notifications;
- Refuse service to any person we reasonably believe to be a repeat infringer;
- Refuse to process refund requests for terminated repeat infringer accounts.
8. No liability for third-party content
Apollo Group TV does not create, upload, host or control any audio, video or multimedia content accessible through its platform. All streams are provided by independent third-party sources. We make no representations or warranties regarding the legality of content provided by third parties.
Users are solely responsible for ensuring that their use of our service complies with all applicable local, state, national and international laws and regulations, including copyright laws.
